Taking property from a store is called shop lifting. If the value of the property taken is more than $200, or if the shop lifter has at least two prior convictions for shop lifting or some other theft related offense, the commonwealth attorney can charge the shop lifting as a felony.

Except in extraordinary circumstances, persons convicted of burglary, robbery, assault or homicide often face significant time to serve in the state penitentiary. Use of firearm, even a simulated one, during the commission of these crimes results in a mandatory minimum sentence of three years in the state penitentiary for a first offense, and five years for a second or subsequent conviction.
